Michael T. Smith
Michael T. Smith is a registered patent attorney registered to practice in patent cases before the United States Patent and Trademark Office. Mr. Smith has over ten years experience in litigating patent, trademark and copyright cases in the federal and state courts of California and federal court in Delaware, with an emphasis on design patent litigation. He has been involved in numerous design patent cases on behalf of Plaintiffs seeking to enforce a design patent against infringers and on behalf of Defendants who have been accused of infringement. Also, he has experience preparing design patent applications and can assist your business in filing United States and foreign applications. Michael also has experience involving utility patent litigation and can advise your business regarding enforcing a utility patent or defending against infringement.
Michael also has extensive experience in litigating trademark infringement cases on behalf of Plaintiffs and Defendants in California federal and state court. He also has filed numerous trademarks for clients and is experienced in prosecuting trademark applications before the Examiner of Trademarks and preparing foreign trademark applications. Michael is experienced in reviewing trademark searches for potential confusion from other marks and he can advise your business regarding potential infringement.
Appellate work is another area Michael has earned experience. He has drafted appeals and prepared the excerpts of record for appeals to the United States Court of Appeals for the Ninth Circuit and California Court of Appeals. Michael has helped obtain a reversal of a California trial court’s granting of summary judgment and has obtained the removal of the trial judge pursuant to California law.
Michael has also been involved in numerous copyright infringement, trade dress, trade secret, contract, licensing, and other business litigation cases in California federal and state courts. He has experience in all aspects of litigation including filing complaints, pre-trial discovery and pre-trial briefing, summary judgment motions, trial work, post trial briefing, judgments and settlements.
He is admitted to practice in all California federal and state courts. His educational experience includes earning one hundred and thirty eight units in Electrical Engineering from California State University, Los Angeles. In 1992, he earned his Juris Doctorate from Southwestern University, Los Angeles. In 1989, he graduated from California Polytechnic University, Pomona with a Bachelor of Arts in Behavioral Science and was on the honor roll.
